General Terms and Conditions

1. Scope

These Terms and Conditions apply to all services, appointments, tattoo designs, and related offerings provided by Agnes Hayden.
Any deviating terms proposed by the client shall only apply if expressly confirmed in writing by Agnes Hayden.

2. Contract Formation

A binding contract is concluded once an appointment has been confirmed by Agnes Hayden, regardless of whether the booking was made in person, by telephone, email, WhatsApp, Instagram, or any other written communication.

3. Design Fee

For custom tattoo projects, a design fee is payable before any design work begins. The design fee covers the time and creative work involved in developing an individual tattoo design. Reasonable revisions are included as part of the design process. Every custom design is created specifically for the commissioned project. While reasonable revisions are included, the artistic interpretation and final composition remain at the discretion of Agnes Hayden.

If the client decides not to proceed with the tattoo after the design process has begun, the design fee remains non-refundable as compensation for the completed design work. If the tattoo is carried out by Agnes Hayden, the design fee will be credited toward the final tattoo price.

4. DESIGN CONCEPTS AND UNUSED ARTWORK

During the design process, multiple concepts, drafts, or alternative versions may be created.
Any design that is not selected and tattooed remains the exclusive intellectual property of Agnes Hayden and may be reused, modified, published, or offered to other clients at her discretion. Payment of the design fee does not transfer ownership or exclusive rights to unused concepts, drafts, or preliminary artwork.

5. APPOINTMENT DEPOSIT

A deposit is required to reserve a tattoo appointment. The deposit secures the appointment and will be credited toward the final tattoo price upon completion of the tattoo.

6. PRICES AND PAYMENT

All prices are stated in Euro (€) and include statutory VAT where applicable.
Quoted prices are estimates unless expressly agreed otherwise in writing.
The remaining balance is due immediately after completion of the tattoo.
Accepted payment methods are cash or immediate bank transfer.

7. Appointment Cancellation and Rescheduling

1. Cancellation or rescheduling at least three days before the appointment

Appointments may be cancelled or rescheduled without providing a reason.
Deposits may be refunded or transferred to a new appointment at the discretion of Agnes Hayden.

2. Cancellation or rescheduling less than three days before the appointment

Appointments cancelled within three days of the scheduled date are only accepted without loss of the deposit in cases of illness supported by a medical certificate.
The medical certificate must be provided within three days of the original appointment.
Without appropriate documentation, the deposit will be forfeited.

3. Failure to attend

If the client fails to attend the appointment without prior notice, the deposit will be forfeited.

8. CLIENT RESPONSIBILITIES

Clients are responsible for providing complete and accurate information regarding relevant medical conditions, allergies, medications, pregnancy, skin conditions, or any other circumstances that may affect the tattoo procedure.

Clients are also responsible for following the aftercare instructions provided after the appointment.

Agnes Hayden reserves the right to postpone or refuse an appointment if proceeding with the tattoo would be considered unsafe or if relevant information has not been disclosed.

9. ORIGINAL ARTWORK AND UNIQUENESS

Every tattoo created by Agnes Hayden is a unique, one-of-a-kind artwork and will only be tattooed once.

Agnes Hayden retains the copyright to all original artwork and reserves the right to use any design, in whole or in part, for portfolios, exhibitions, publications, prints, merchandise, promotional material, or future artistic projects.

10. COPYRIGHT AND USAGE RIGHTS

All tattoo designs, sketches, concepts, and artwork created by Agnes Hayden remain protected by copyright.
Payment of a design fee or purchase of a tattoo does not transfer any copyright, ownership, or reproduction rights to the client.

Designs may not be copied, reproduced, tattooed by another artist, distributed, published, or otherwise used without the prior written permission of Agnes Hayden. Individual tattoo designs are created exclusively for execution by Agnes Hayden. Purchasing a design does not grant the right to have the design tattooed by another artist.

11. PHOTOGRAPHY AND VIDEO

Photographs and videos of completed tattoos may be taken for portfolio, exhibition, website, social media, and promotional purposes.

If a client does not wish images of their tattoo to be published, this must be communicated before the appointment. Personal privacy will always be respected, and identifying features will only be shown where appropriate.

12. Liability

Agnes Hayden is liable for damages caused intentionally or through gross negligence.
Liability for slight negligence is excluded to the extent permitted by applicable law.
No liability is accepted for personal belongings brought to the appointment.

13. Data Protection

Personal data is collected and processed exclusively for the purpose of fulfilling the contractual relationship and in accordance with applicable data protection legislation.

14. RIGHT TO REFUSE SERVICE

Agnes Hayden reserves the right to refuse or discontinue a tattoo appointment if a client appears to be under the influence of alcohol or drugs, behaves aggressively or inappropriately, fails to provide relevant medical information, or if proceeding with the tattoo would otherwise be considered unsafe or inappropriate.

15. Final Provisions

Changes or additions to these Terms and Conditions must be made in writing.

Should any provision of these Terms and Conditions be found invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

These Terms and Conditions are governed by Austrian law.
The competent court shall be the court having jurisdiction over the registered business location of Agnes Hayden.
